CANYONVILLE PLANNING COMMISSION MINUTES

REGULAR SESSION

August 13, 2014

 

I.                          Call to Order and Pledge of Allegiance:

Commissioner Emory called the meeting to order at 7:00 p.m. and all joined in the Pledge of Allegiance.

 

II.              Roll Call:

COMMISSION PRESENT:    Chairman Emory, Commissioners Hill, Ravera, Sales, and Butler

COMMISSION ABSENT:      Commissioner Boye and Weigel were absent.

STAFF PRESENT:                 Administrator/Recorder Evans

STAFF ABSENT:                   None.

 

IV.             Agenda Review/Additions:

            None

 

V.              Approval of Minutes –

1.     Regular Session/ 06-11-14

 

Commissioner Butler moved, Commissioner Sales  seconded a motion to approve the minutes of the 6-11-14 Regular Session meeting as written.  All voted “yes”.  The motion carried.

 

VI.             New Business:

                  1.  Discussion regarding amending the Commercial zone to allow legally established residential uses as a permitted use.

 

             Administrator Evans explained that under the existing zoning ordinance a residential use is not allowed
                  in the Commercial zone.   However, there are many residential uses in Canyonville that are located in the
                  Commercial zoning.  The uses are considered non conforming and are allowed to stay as they currently 
                  exist.  Repairs can be made to the existing buildings but they cannot be expanded and no new residential
                  buildings such as garages can be added.  The theory behind the regulation is that the structures will be 
                  torn down and the properties will be converted to a Commercial use.  However, there has not been a 
                  big demand for Commercial property in Canyonville and most of these lots remain developed with single
                  family dwellings.  For these property owners it is difficult to enjoy the full use of their property when 
                  they are not able to expand the buildings or add any new buildings.

 

                  Rezoning the lots with residential uses is very problematic.  The City is required by state law to have a 
                  certain percentage of land zoned for commercial use and Canyonville’s commercial land supply is very
                  limited.  Whenever land is changed from a commercial designation to a residential zone the City is
                  required to send notification to the Department of Land Conservation and Development.  They review
                  the decisions to insure the City adheres to all land use laws and can challenge a rezone of property.  It is
                  not certain whether they would have an issue with the rezoning of these lots.

 

                  It appears that the best solution to this dilemma would be to amend the Commercial C1 zone to allow
                  legally established residential uses as a permitted use.  That would mean that the existing 
                  residential uses could enlarge their homes or add new structures and the City could retain the  
                 
existing commercial base.  It would be a win-win for everyone.

                  Administrator Evans asked the Planning Commission if they would like to consider amending the ordinance.  She will begin the process if the Commission desires to amend the ordinance.

 

                  It was the consensus of the Commission that it would be a good idea to add existing legally established residential uses to the permitted uses in the Commercial C1 zone.

 

                  Administrator Evans will proceed with the amendment.  The first public hearing will be before the Planning Commission at the October 8, 2014 meeting and the final hearing will be before the City Council at the October 20, 2014 meeting.
