5.04.010 Purpose--Scope.

The business license fee imposed by this chapter is for the purpose of partially defraying the costs to the city in protecting business activity within the city. Neither the acceptance of the prescribed fee nor issuance of a license shall be construed to permit any activity otherwise unlawful. (Ord. 346 § 1, 1980)

5.04.020 Definitions.

“Business” means any activity carried on for the purpose of realizing economic gain for the owner and during which patrons, customers, clients or patients come onto or into a business premises located within the city. (Ord. 346 § 2, 1980)

5.04.030 Business license required.

It shall be unlawful for any person, partnership or corporation to do business within the city unless it has a valid, current business license. (Ord. 346 § 3, 1980)

5.04.040 Applications.

Applications for business licenses shall be submitted on forms to be provided by the city recorder. Every application shall be signed by the owner or his agent and shall contain the following information:
A. Name of person or persons owning business;
B. Assumed business name, if any;
C. Address of business premises, or business mailing address, if different;
D. Nature of business; and
E. Number of living or space-rental units, if applicable. (Ord. 346 § 4, 1980)

5.04.050 Issuance.

Upon receipt of a proper application and the required fee, the city recorder shall issue a business license. Licenses shall not be transferable and shall be valid until the thirty-first day of December next following the date of issuance of the license. (Ord. 346 § 5, 1980)

5.04.060 Contents of licenses.

Licenses shall contain the name of the business, the nature of the business, the address of the business premises, and the date of issuance. (Ord. 346 § 6, 1980)

5.04.070 Two or more business premises--Two businesses in single premises.

The conducting of a business at two or more locations shall be deemed to be separate businesses and each shall be subject to the license tax provided for in this chapter. Where two or more business activities are carried on in the same premises, any separate ownerships shall be deemed to create a separate business. (Ord. 346 § 7, 1980)

5.04.080 License fee and term.

The license fee required by this chapter shall be fixed by resolution of the city council and may be amended by subsequent resolution of the council. The prescribed fee shall be for a full calendar year term, provided that any business commencing its operation after the expiration of the first calendar quarter, i.e., after March 31st, shall pay a prorated license fee based on the number of calendar quarters remaining in the year at the beginning of the calendar quarter first preceding the commencement of business. 5.04.090 Violation--Penalty.

A. Every full business day during which any business activity continues to be conducted in violation of this chapter shall be deemed a separate offense.
B. No license shall be issued to any person who has, previous to making application therefor, conducted a business within the city while this chapter was in effect without a current valid license unless such person pays an additional amount equal to the license fee for the period during which business was thus conducted.
C. The city may, at is option, pursue civil or criminal remedies to correct any violation of this chapter. (Ord. 346 § 10, 1980)
